The Ontario Securities Commission (OSC) is the statutory body responsible for regulating Ontario’s capital markets in accordance with the mandate established in the provincial Securities Act and the Commodity Futures Act. The mandate of the OSC is to provide protection to investors from unfair, improper, or fraudulent practices, to foster fair, efficient and competitive capital markets, and confidence in the capital markets, to foster capital formation, and to contribute to the stability of the financial system and the reduction of systemic risk. This mandate is performed through policy, operational and enforcement activities. The OSC also contributes to national and global securities regulation development.
We are recruiting for Senior Litigation Counsel to join the OSC Enforcement team that investigates quasi-criminal and criminal offences related to securities, pursuant to the Provincial Offences Act and the Criminal Code of Canada. Working in a dynamic, fast-paced environment on a multi-disciplinary team, as Senior Litigation Counsel, you will help guide complex investigations and identify potential breaches of Ontario securities law. You will identify important legal issues and assist with formulating strategies for successful investigations. You will analyze and evaluate evidence to determine whether violations have occurred and recommend for appropriate action.
In addition, you will lead teams to conduct prosecutions for securities offences in quasi-criminal proceedings before the Ontario courts and be responsible for the organization of disclosure, drafting appropriate allegations and liaising with defence counsel and other stakeholders in your day-to-day duties. You will also appear in court to seek remedies, such as receiverships and freeze directions. Securities litigation and/or prosecutorial experience is preferred. Candidates must have a minimum of 10 years’ experience and be or are able to become a lawyer licensee of the Law Society of Ontario in good standing. Previous experience leading large or complex hearings or trials is essential.
